1. Acceptance of Terms

Welcome to Ashes Trade Market (the "Service"). By accessing or using our platform, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the service.

2. Eligibility & Accounts

Age. You must be at least 13 years old to register or use interactive features. If you are 13–17, you confirm you have parental/guardian permission. Children under 13 must not use the Service.

Registration. Browsing is anonymous. To post or list trades, you must create an account with a valid email and password. You’re responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of any unauthorized use.

Accuracy. Provide accurate information and keep it updated. We may suspend or terminate accounts that are false, impersonate others, or evade bans.

3. Description of Service

Ashes Trade Market is a community-driven platform for Ashes of Creation players to buy, sell, and trade in-game items, gear, and resources. We provide the infrastructure and tools for safe peer-to-peer trading.

4. Acceptable Use

You agree not to:

Use the Service for any illegal purpose or to violate any laws or rights.
Harass, abuse, defame, or post hateful, obscene, or exploitative content.
Post others’ personal data (doxxing) or infringe intellectual property.
Spam, phish, or manipulate ratings/feedback; create fake or deceptive listings.
Reverse engineer, disrupt, or attempt unauthorized access to the Service.
Use bots or automation that burdens the Service without written permission.
Violate the game’s policies (e.g., prohibited real-money trading or account sales).

5. User Content & Intellectual Property

Your Ownership. You own the content you post. By posting, you grant Ashes Trade Market a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content in connection with the service.

Warranties. You represent that you have the rights to post your content and that it does not infringe others’ rights or violate laws.

Moderation. We may remove or restrict content at our discretion for violations of these Terms or legal concerns.

Fan Status. Ashes of Creation is the IP of Intrepid Studios. Ashes Trade Market is an unofficial fan platform and is not affiliated with, endorsed by, or sponsored by Intrepid Studios.

6. Trading & Transactions

No Intermediary. We do not provide escrow, payment processing, or guarantees. Trades occur solely between users.
Own Risk. You assume all risk for trades. Verify partners and follow safe practices.
Disputes. We do not arbitrate user disputes. We may remove bad-faith listings or ban repeat offenders but are not liable for outcomes.
Prohibited Transactions. Do not use the Service for illegal activity or activity prohibited by the game’s terms (e.g., account sales if banned).

7. Third-Party Links, Ads & Future Monetization

The Service may contain links to third-party sites. We are not responsible for their content or practices. Your dealings with third parties are solely between you and them.

We may introduce ads, sponsorships, subscriptions, or other paid features in the future. Any such changes will be disclosed, and additional terms may apply.

8. Privacy

Your use of the Service is governed by our Privacy Policy (see /privacy). It describes what we collect, how we use it, your rights, cookies, security, and data retention.

9. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that content will be accurate or reliable.

You rely on any content or trades arranged through the Service at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, Ashes Trade Market and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

11. Indemnification

You agree to indemnify and hold harmless Ashes Trade Market and its operators from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the service or violation of these terms.

12. Suspension & Termination

We may suspend or terminate access (with or without notice) for any violation of these Terms, legal risk, inactivity, or other reasons at our discretion. You may stop using the Service at any time; deleting your account is available upon request or via your settings (if enabled).

Certain provisions survive termination, including ownership, licenses (to the extent content remains displayed), disclaimers, limitations of liability, indemnity, and governing law.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of Ukraine (without regard to conflict-of-law rules). You agree to the exclusive jurisdiction of the courts located in Kyiv, Ukraine, except where mandatory consumer protection laws grant you the right to bring claims in your home jurisdiction.

14. Miscellaneous

Entire Agreement. These Terms (plus the Privacy Policy and posted rules) are the entire agreement between you and us.
Severability. If a provision is unenforceable, the remainder remains effective.
No Waiver. Our failure to enforce a right is not a waiver.
Assignment. You may not assign these Terms without consent; we may assign as permitted by law.
Headings. Headings are for convenience and have no legal effect.
